US bans the oil exporter company

Khalistan organization gave threat to burn the Indian flag on January 26


In America, a Khalistan organization has warned of 'burning Indian flag'. This organization has said that it will burn this flag in front of the Indian Embassy building located in Washington DC on the occasion of Republic Day. The organization 'Sikh for Justice' has also sent an invitation to all its supporters to join this protest.

It is tragic that according to American law, such an event can not be stopped. The organization has requested the people in their invitation to demonstrate in a public park in front of the Indian Embassy located in Massachusetts Avenue in Washington, DC.

Khalistan organization said in its statement, "We will oppose Article 25 (b) of the Indian Constitution in which Sikhs are said to be Hindu." Significantly, the national flag is also dear to the Indians, and it is considered a criminal act to burn the nation's flag in India. But according to American law, doing so is not a crime. Apart from the 'first amendment' of the American Constitution, the 'rights' of burning or disrespecting the national flag of the protesters has also been protected.

Similarly, the U.S. Supreme Court twice has confirmed in 1989 and 1990 that the right to humiliate the American national flag also falls under a kind of freedom of expression. In the 1989 Texas vs. Johnson case, the U.S. Supreme Court declared the ban on the US flag being declared illegal.

The Khalistan organization taking advantage of this legal path is preparing to perform anti-India demonstrations on the occasion of the 70th Republic Day of India. Sources in the Government of India say that they have already given information to many countries about this organization and its funding, and have expressed their concerns. This Khalistani organization advocates the alleged Kashmir movement while favoring Pakistan.

Faulty medical devices: Government sets up panel to frame rules for compensation


In good news for patients, the government has set up an expert panel to frame rules for compensation in case of an adverse event due to a faulty or unsafe medical device.

Health ministry’s apex panel has cleared formation of the sub-committee to amend Medical Devices Rules, 2017, to include provisions for compensation on the grounds of a malfunction in the device, or it being unsafe or non-compliant.

This would help plug a loophole in the rules, as under the existing dispensation, the government initially found itself “helpless” in handling the Johnson & Johnson hip implant case.

The decision to bring in separate rules has been taken to simplify the legal process, cut down time and multiple stages. A case of an adverse event due to a medical implant is difficult to prove in the existing system and lacks clarity in law, experts said earlier.

The need for a legal provision for compensation is especially important for India with its socio-economic demographics, which may not have the strength to fight against powerful corporates in courts, sources said. The compensation will have to be given in the case where an adverse event or death is reported only for already approved devices, and not those which are under clinical trials.
